Welcome to Daymora. By accessing or using our unlimited AI API service, you agree to be bound by these Terms of Use ("Terms"). Please read them carefully. If you do not agree, do not use our service.
1. Definitions
- "Service" means the Daymora AI API platform, including the website, API, dashboard, and related features.
- "You" or "User" means the individual or entity using the Service.
- "Content" means any data, prompts, or materials you submit to the Service.
2. Service Description
Daymora provides unlimited AI API access for a flat monthly fee of $25. The Service includes access to premium AI models, API key management, usage analytics, and a web dashboard. Subscription terms, features, and pricing may be updated with reasonable notice.
3. Account Registration and Eligibility
You must create an account to use the Service. You represent that you are at least 16 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Violate any applicable law, regulation, or third-party rights
- Use the Service for illegal, harmful, or fraudulent activities
- Attempt to circumvent security measures, rate limits, or access controls
- Transmit malware, spam, or content that infringes intellectual property
- Use the Service to generate content that is defamatory, harassing, or harmful
- Resell, sublicense, or redistribute the Service without authorization
- Reverse engineer, decompile, or attempt to extract source code
We reserve the right to suspend or terminate accounts that violate these terms or pose a risk to the Service or other users.
5. Payment and Subscription
Subscription fees are billed monthly. Payment is processed through our payment provider (e.g., PayPal). By subscribing, you authorize us to charge your payment method. Fees are non-refundable except as required by law or as expressly stated in our refund policy. We may change pricing with at least 30 days' notice.
6. Intellectual Property
Daymora and its licensors retain all rights in the Service, including software, design, trademarks, and documentation. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal purposes. You retain ownership of your Content, but you grant us a license to process it as necessary to provide the Service.
7. Data Protection and Privacy
Our processing of personal data is governed by our Privacy Policy, which is incorporated into these Terms. We process data in accordance with GDPR and applicable data protection laws. By using the Service, you confirm that you have read and accept our Privacy Policy.
8. Security and Availability (ISO Alignment)
We implement technical and organizational measures aligned with information security best practices (including principles reflected in ISO 27001) to protect the Service and your data. We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice where practicable.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Daymora, its affiliates, and their officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your Content; or (d) your violation of any third-party rights or applicable law.
11. Termination
You may cancel your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or for any reason with reasonable notice. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g., intellectual property, limitation of liability, indemnification) will survive termination.
12. Dispute Resolution
We encourage you to contact us first to resolve any dispute. If a dispute cannot be resolved informally, it shall be subject to the governing law and jurisdiction set forth below. For EU consumers, mandatory consumer protection laws of your country of residence apply, and you may bring proceedings in your country of residence.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the jurisdiction in which Daymora operates, without regard to conflict of law principles. Any legal proceedings shall be brought in the courts of that jurisdiction, except where prohibited by mandatory consumer protection laws.
14. Changes to Terms
We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may provide additional notice (e.g., by email). Continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
